Turkish ECAA Routes

The European Communities Association Agreement (ECAA) routes continue to provide transitional immigration rights for certain Turkish ECAA Businesspersons, ECAA Workers and their family members who were already within the ECAA framework before the end of the EU transition period. Appendix ECAA Extension of Stay lets qualifying existing Businesspersons and Workers extend their permission, contains provisions for qualifying family members and for certain dependent children applying to enter the UK, and a person with qualifying ECAA permission can progress to settlement under Appendix ECAA Settlement.

ECAA is now a transitional route — it is not open to new Turkish Businessperson or Worker applicants. The framework principally protects people who obtained, or successfully applied for, qualifying ECAA status before the end of 31 December 2020. It is not a route for a Turkish national to start a new Businessperson or Worker application today. A limited exception exists for qualifying dependent children, who can still apply for entry clearance under Appendix ECAA Extension of Stay in the circumstances provided by the Rules.

What is the Turkish ECAA route?

The ECAA immigration arrangements arose from the European Community Association arrangements with Turkey. Before the end of the transition period, they provided particular rights for qualifying Turkish Businesspersons engaging in self-employment or business activity, and Workers acquiring employment rights through lawful employment. Following the end of the transition period, the UK introduced Appendix ECAA Extension of Stay to preserve extension rights for qualifying people already within the route.

"Ankara Agreement" is commonly used to describe the historical Turkey–EEC association arrangements behind these routes, but the current UK Immigration Rules use the ECAA terminology.

The current framework divides into four groups of people already within, or linked to, the ECAA route.

A Turkish national who obtained, or successfully applied for, relevant ECAA status before the cut-off and continues to qualify as a businessperson may apply for further permission.

ECAA Turkish Businessperson

The Businessperson route concerns qualifying Turkish nationals continuing business activity under their preserved ECAA status. The extension guidance describes an applicant who must be a Turkish national, have obtained or successfully applied for qualifying ECAA leave by the relevant pre-2021 cut-off, and continue to be self-employed consistently with the ECAA conditions. The detailed application then examines the actual business — including its continuation, viability, the applicant's involvement, finances and ability to support the applicant and any dependants.

ECAA Businessperson permission is not unrestricted general employment permission. Businesspersons granted extension permission are authorised to work in the business or businesses they have established, joined or taken over, subject to their ECAA conditions. ECAA Turkish Worker

The Worker side of the ECAA framework is distinct from the Businessperson route. The guidance describes qualifying ECAA Workers as Turkish nationals with preserved rights based on lawful employment who continue to work consistently with their ECAA permission. Worker rights develop according to the relevant period and nature of lawful employment — the guidance distinguishes stages including continued work with the same employer, later access to employment in the same occupation, and, after the relevant four-year stage, unrestricted employment.

Extensions

Extending ECAA permission

Both strands extend in-country, but on different tests and for different periods.

Businessperson

Businessperson Extension

Qualifying Businesspersons may receive a normal further grant of 36 months where the requirements are met. A shorter 12-month grant may be appropriate in some cases — for example where a business is established but its continued success still needs to be demonstrated.

The Worker extension depends on rights established through lawful employment — for example an applicant with three years of legal employment remains subject to the same-employer / same-occupation restriction for the next stage, while an applicant reaching four years of legal employment can be granted unrestricted work.

For an in-country dependent-partner extension, the current validity rules require the applicant to be in the UK and to already have permission to stay as a dependent partner on the ECAA route. ECAA is not a general new overseas partner-entry route.

Children are treated differently from new dependent partners: Appendix ECAA expressly provides for qualifying children of ECAA Workers and Businesspersons to apply for entry clearance from outside the UK, as well as relevant in-country provisions.

Can ECAA lead to indefinite leave to remain?

Yes — the extension Appendix expressly signposts settlement under Appendix ECAA Settlement.

ECAA Family Member Settlement

Appendix ECAA Settlement contains separate requirements for children and partners of ECAA Workers or Businesspersons — for example, a qualifying partner must remain in a genuine and subsisting relationship with the ECAA principal and intend to live permanently together, alongside the other settlement requirements.

Conditions, public funds & where you apply

ECAA permission normally carries no recourse to public funds and work rights according to the specific ECAA category and stage. Study is also permitted, subject to the relevant ATAS condition where applicable. The detailed, category-specific work conditions belong on the Businessperson and Worker guides.

For ECAA Workers and Businesspersons, the current validity requirements require the main applicant to be Turkish, to provide the required identity and biometric material, and to be in the UK — reinforcing the transitional, in-country nature of the route. The main exception is that qualifying dependent children can use an entry-clearance route.

Administrative Review. Certain ECAA extension refusals may carry Administrative Review rights, depending on the decision. Fees, the Immigration Health Surcharge and processing times are operational details that change — confirm the current position on GOV.UK.

Frequently asked questions

Is the Turkish ECAA Businessperson route still open to new applicants?

Not as a new general Businessperson route. The current framework is transitional for qualifying people who were already within the ECAA system by the relevant pre-2021 cut-off.

Can an existing ECAA Businessperson extend their visa?

Potentially, where they continue to satisfy Appendix ECAA Extension of Stay.

Can an ECAA Worker extend?

Potentially, subject to the relevant ECAA worker-right and employment requirements.

Can I switch into ECAA from another UK visa?

The current Worker / Businessperson extension route is for qualifying existing ECAA holders, not general switching into ECAA.

Can an ECAA partner apply from overseas for a new dependant visa?

The current extension framework specifically protects existing dependant-partner permission; do not assume there is a general new overseas partner route.

Can an ECAA child apply from outside the UK?

Yes — Appendix ECAA contains entry-clearance provisions for qualifying dependent children.

Can an ECAA Businessperson apply for ILR?

Can ECAA partners and children settle?
