Innovator Founder settlement has its own route-specific qualifying period. Do not assume time on another route can simply be transferred into this settlement framework.

The 3-year settlement qualifying period

The Innovator Founder settlement route requires a continuous qualifying period of 3 years.

The Home Office guidance describes this as three years of lawful residence with permission as an Innovator migrant. The qualifying period is therefore route-specific.

Do not combine this with another route without a source basis. Unlike some settlement routes, the Innovator Founder guidance does not provide a general framework for combining time from unrelated immigration categories into the three-year period.

You need a settlement endorsement

Settlement requires a current endorsement from an endorsing body or, where the Rules permit, an appropriate legacy endorsing body.

This is not simply a repeat of the initial endorsement. The settlement endorsement must assess what has happened since the business was originally endorsed.

The endorsing body must confirm significant achievements judged against the business plan assessed in the previous endorsement.

Business status

Registered, active and trading

The business must be registered with Companies House, the applicant must hold the required formal position, and the business must be active and trading.

Sustainability

Business sustainability

The endorsing body must assess whether the business appears sustainable by considering its assets, expected income and current and planned expenses.

Role

Active key role

The applicant must demonstrate an active key role in the day-to-day management and development of the business.

A passive financial interest alone is not enough. The Innovator Founder framework requires active involvement in the business.

Settlement focuses on what the business has actually achieved

Initial Innovator Founder endorsement focuses on the proposed business and the applicant's role in developing it. Settlement instead looks at the progress and achievements made during the route.

The endorsing body must assess those achievements against the previously endorsed business plan and confirm that the business remains active, trading and sustainable.

Initial endorsement and settlement endorsement are different. A business having been endorsed at the start of the route does not by itself establish the settlement requirements. The settlement endorsement must address the business's actual progress and current position.

The business must meet at least two settlement achievement criteria

The settlement endorsement must confirm that the business venture has met at least two of the achievement criteria set out in Appendix Innovator Founder.

Two distinct criteria are required. Exceeding one settlement criterion by a larger amount does not allow the same criterion to be counted twice. The business must satisfy at least two distinct criteria.

The detailed thresholds within the settlement criteria can change. Confirm the current Appendix Innovator Founder requirements on GOV.UK before relying on a particular criterion.

What if more than one Innovator Founder is relying on the same business?

Where several Innovator Founder applicants are relying on the same venture for settlement, the same business achievement cannot automatically be used in the same way for every applicant.

The Rules contain specific restrictions on sharing settlement achievement criteria between team members.

Team cases need separate settlement planning. Each applicant's settlement position should be mapped against the business achievements available to that applicant.
